When deciding to put up a new fence around your garden, you may not be thinking about the laws regarding fences. However, there are laws that must be taken into consideration whenever a fence is about to be constructed and erected upon a person’s property.
Many people are under the presumption that the maximum permitted fence height is 2 M. This is a falsity propagated on misleading websites. The laws actually state that a fence can be as high as 100 meters. However, this is only allowed if proper planning permits have been obtained. This means that any fence under 2 meters in height does not require a permit.
This simple law has a few complications to it. You would need to get planning permission for putting a trellis on a fence of 2 meters. However, if any plant that you grow on that trellis exceeds 2 meters, you do not need to obtain a permit for the growing plant.
When you live in a house that has a garden fence on each side of it, there arises a problem regarding who owns which fence and who is responsible for that fence’s repairs. As with the aforementioned law, this simple one has a bit of complexity to it.
An old belief is that if you stand and the house is behind you the fence to your right is the one you are responsible for, and that fence is the one you own. This is not true. If the post to any fence is on your property then the fence itself is yours.
Take the laws that are similar for ditch divided and hedge divided farms. The ditch has to be dug on your land and a mound of soil must be thrown on your land for it to be yours.
Aside from location and height, safety must be considered when a fence is about to be installed. If your fence should border a public foot path or path, the fences must be safe for anyone walking near it. In light of this, barbed wire fences would be illegal as they pose a hazard to people walking past it on foot.
Another hazardous fence would be one with smashed glass concrete. These might be theft deterrents, but they are not permitted by law because of the hazard they pose to innocent people walking past your home.
