A diferença existente é que os crimes hediondos estão previstos em um rol taxativo na lei 8.072 de 1990 escolhidos através do critério legal, isto é, o legislador infraconstitucional observou quais os crimes em que a reprimenda deveria ser mais rigorosa. Já os crimes equiparados já aqueles que não estão no rol taxativo da lei em questão, mas o legislador equiparou eles para fins de aplicação/execução/progressão de pena.
